The Granite State is a Great State for Gay Surrogacy

The great state of New Hampshire is a great state for LGBTQ+ intended parents to pursue gestational surrogacy.  Read on to find out why.

New Hampshire may be a tiny state (the 5th smallest in the nation) but we are big when it comes to LGBTQ+ family building.  New Hampshire was the first state in the country to voluntarily pass a law recognizing same-sex marriages.  And one of the first to pass an LGBTQ+ friendly surrogacy law (written by our own Co-Director Catherine Tucker).  Here are some highlights of New Hampshire’s surrogacy law:

  • Gender neutral language to cover all Intended Parents

  • Intended Parents can be a married couple, unmarried partners, or single

  • Donor eggs and donor sperm are both expressly permitted (you can even use both donor eggs and donor sperm—not too many states allow for that!)

  • No requirement of *proving* medical infertility

  • Same results for gay intended parents across the state

All good stuff and why New Hampshire is top of our list for gay intended dads and moms.  But that’s not the only law that New Hampshire has that makes it a great place for gay surrogacy.  

New Hampshire’s fertility insurance mandate requires the most generous coverage in the nation for LGBTQ+ surrogacy.  The law recognizes that gay men, lesbian women, and transgender folks can all be infertile.  And you don’t have to prove that you are infertile in ways that are more onerous than what is required of straight couples.  How great is that?

New Hampshire’s location provides easy access to the many top-notch IVF centers in the Greater Boston area.  And Boston IVF even has a New Hampshire based facility that will soon offer a full lab right here in the Granite State.  This means New Hampshire gay intended dads and moms don’t even have to leave the state to make surrogacy happen 

Even better your surrogate can take care of all her medical needs without leaving New Hampshire.  Although if your pregnancy ends up high-risk, New Hampshire provides easy access to the world class medical care available in Boston.  The one downside for your surrogate is that she will miss out on the great skiing that New Hampshire offers every winter. But there’s still plenty for her to do safely—boating, concerts, hanging out on Hampton Beach, visiting the Strawberry Banke Museum in Portsmouth, and so forth.     

 Plus, New Hampshire just has an overall LGBTQ+ friendly vibe.  You can easily change your gender on your driver’s license and even have your gender recorded as “X” instead of “M” or “F”.  Gay conversion therapy for kids is not allowed in New Hampshire.  With 75% of New Hampshire residents supporting same-sex marriage, it shouldn’t be a surprise that most New Hampshire surrogates are open to the idea of helping a gay couple become parents.  An extra bonus is that many New Hampshire insurance policies are “surrogacy friendly”.
